Welcome to FoxVision. These Terms of Service (“Terms”) govern your access to and use of the FoxVision website and tools at https://foxvision.ai (the “Service”), operated by FoxVision (“we,” “us,” “our”). By creating an account, purchasing credits, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use FoxVision. By using the Service, you represent that you are 18 or older and legally able to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us at support@foxvision.ai if you suspect unauthorized use. We are not liable for losses arising from unauthorized access caused by your failure to secure your account.

3. Credits and Payment

FoxVision operates on a credit system. Credits are purchased to access our AI generation tools and are consumed as you use them. Credits do not expire. All purchases are subject to our Refund Policy, which is incorporated into these Terms by reference. By purchasing credits, you acknowledge and agree that credits are non-refundable except as described in the Refund Policy.

4. The Service and AI-Generated Content

FoxVision provides tools that generate content (images, video, motion, lip sync, and music) using third-party AI models. You understand and agree that:

AI-generated output is inherently variable and unpredictable. We do not guarantee that any generation will meet your expectations, be error-free, or be fit for any particular purpose.
Your inputs are processed by third-party AI providers (including Replicate and the underlying model providers) as described in our Privacy Policy.
We do not review or pre-screen all generated content and are not responsible for content you create using the Service.

5. Ownership of Your Content

As between you and FoxVision, you own the content you generate using the Service, and you may use it for personal or commercial purposes, subject to these Terms.

You acknowledge that:

Your rights in generated content are subject to the terms of the third-party AI providers whose models produce the output, and to applicable law.
The legal status of AI-generated content, including whether it is eligible for copyright protection, varies by jurisdiction and may be uncertain. We make no representation or warranty that generated content is protectable, original, or free from third-party claims.
You are solely responsible for how you use, distribute, and monetize your generated content, and for ensuring that your use complies with all applicable laws and third-party rights.

You retain responsibility for any content you upload as input, and you represent that you have the necessary rights to upload and process it.

6. Acceptable Use

You agree not to use the Service to create, upload, generate, or distribute any content that:

Is illegal, or promotes or facilitates illegal activity;
Sexualizes, exploits, or endangers minors in any way (we have zero tolerance for child sexual abuse material and will report violations to the appropriate authorities);
Depicts non-consensual intimate or sexual imagery of any real person;
Creates a likeness, voice, or depiction of a real, identifiable person without their consent, including for the purpose of deception, impersonation, defamation, or fraud (“deepfakes”);
Infringes the intellectual property, privacy, publicity, or other rights of any person or entity;
Harasses, threatens, defames, or promotes violence or hatred against any person or group;
Contains malware, or is used to compromise, disrupt, or gain unauthorized access to systems or data;
Attempts to circumvent, abuse, or manipulate the credit system, or to resell, reverse-engineer, scrape, or exploit the Service; or
Violates any applicable law or regulation.

You are solely responsible for the content you generate and for ensuring your use complies with these rules and the law.

7. Termination and Suspension

We reserve the right to suspend or terminate your account, and to remove content, at our discretion, with or without notice, including for any violation of these Terms or the Acceptable Use section, or to protect the Service, its users, or third parties. Where an account is terminated for a violation of these Terms, any remaining credit balance may be forfeited. You may stop using the Service at any time.

8. Service Availability

We provide the Service on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time. We may modify, suspend, or discontinue any part of the Service at any time.

9. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, LAWFUL FOR YOUR INTENDED USE, OR FREE OF THIRD-PARTY CLAIMS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FOXVISION AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US FOR THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless FoxVision and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your generated or uploaded content, or your violation of these Terms or any law or third-party right.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Ohio, except where prohibited by applicable law.

14. Storage and Retention of Generated Content

FoxVision stores the files you generate for a limited time so you can download them.

Generated outputs (images, videos, audio, and lip-sync files) remain available in your account for 7 days from the time they are created. After that period they are automatically and permanently deleted from our servers and can no longer be downloaded or recovered.

Uploaded input files (source images, videos, and audio you provide) are used only to produce your generation and are automatically deleted after 3 days.

You are responsible for downloading and keeping your own copies of anything you wish to retain. We do not maintain backups of expired content, and expired files cannot be restored for any reason, including on request.

Records of your account activity — including generation history, credits used, and the settings you selected — are retained separately for a longer period for billing, support, and abuse-prevention purposes.

We may change these retention periods. Material reductions will be announced in advance where practical.
